• • The activity schedules are mandatory. There are no refunds for delays or absences in the activities.

• • Hacienda El Porvenir only accepts payments by credit card or bank transfer (no cash or checks).

• • At Hacienda El Porvenir, there is no cell phone signal coverage, so the hacienda provides free Wi-Fi service.

• • The hacienda is not responsible for lost or forgotten items. Forgotten items found on the hacienda premises will be kept in the office for a period of 90 days and then donated to foundations.

Please read this agreement carefully. If the participant is under 18 years of age, the minor’s parent or legal representative must sign this agreement.

Assumption of risk: You voluntarily agree to participate in the adventure tour/activity you have booked, which may include activities such as hiking, mountain biking, canopy, via ferrata, horseback riding, rock climbing, high mountains, among others; or other outdoor activities.

You decide to voluntarily participate in this tour or adventure activity and recognizes the countless risks involved, which include but are not limited to: all dangers and risks inherent in adventure activities; any type of negligence on the part of Tierra del Volcan / Pumapucara S.A; emotional traumas; disfigurement; temporary or permanent disability, including paralysis; death; act of God; the dangers of traveling to remote areas; traveling through areas of political instability or unsafe areas; the dangers generated by strikes or war; forces of nature; transportation failures; equipment failures; accidents or illness in areas that do not have or have access to medical facilities, evacuation transportation or other means of evacuation or assistance; unexpected events; social or labor strikes; mechanical or construction failures or problems; diseases; local laws; weather conditions; the dangers that height can cause; abnormal conditions; the dangers generated by traveling by car, van, bus, mountain bike, canopy, horse, on foot, or any other vehicle; or any other action, omission, or condition within or outside the control of Tierra del Volcan / Pumapucara S.A. By participating in this tour/Activity, you understand the risks involved in doing these activities.

Having this knowledge, you expressly accept all responsibility for your safety and well-being, and that of all participants under your reservation. You assume at your own risk all dangers and risks involved in participating in this tour/Activity, including both those of which you are aware and those of which you are not aware.

You expressly disclaim all responsibility for your safety and well-being, and that of yours, to Tierra del Volcan / Pumapucara S.A. and undertake not to sue or pursue any legal action for life against Tierra del Volcan / Pumapucara S.A., its owners, shareholders, employees, suppliers, affiliated companies, contractors, sales agents, representatives, officers, directors, associates, volunteers, heirs. You agree to keep them free from any legal action of any kind, such as lawsuits, demands, legal actions, debts, claims of any kind; in relation to the tour/activities you are participating in.

You agree that the terms and conditions of this agreement serve as a complete disclaimer of liability and that you assume all risks; both those of you as well as those of your entire family/group, including minors traveling with you, my and your heirs, successors and legal representatives. It is your decision and intention to assume all risk associated with the tour / Activity and release Tierra del Volcan / Pumapucara S.A. from all liability.

Compensation: Furthermore, you agree to indemnify (defend / pay / reimburse) Tierra del Volcan / Pumapucara S.A against any claim by any person, including minors, arising from a partial or total injury or any loss suffered by me that is related with your participation in this tour / Adventure Activity. Likewise, you declare that the equipment to be used during the established tourist program is in good condition and you agree to return it in the same conditions or will cover the corresponding amount to replace the damaged item.

Jurisdicción: In everything that is not provided for in this contract. The parties are subject to the pertinent legal provisions and in the event of conflict, they renounce jurisdiction and domicile, and submit to the resolution of all disputes that arise from the interpretation, application and compliance of this Contract with the assistance of a mediator from the Center for Arbitration and Mediation of the Quito Chamber of Commerce. In the event that the conflict is not resolved, the parties will submit their disputes to the resolution of an Arbitration Court administered by the Arbitration and Mediation Center of the Quito Chamber of Commerce and its regulations; The court will be made up of three arbitrators chosen, one for each of the parties and the third by drawing lots from the list of arbitrators of the aforementioned center. The arbitrators will be authorized to order the practice of any precautionary measure that may arise and that is requested. by one of the parties and the award issued will be in law.

Acceptance of implications: You declare that you have carefully read this agreement and understand the legal consequences of accepting these terms and agree to all its clauses and conditions. You agree that if for any reason, one of the provisions of this agreement is not applicable or enforceable, all other provisions remain in effect.

You understand that to establish the costs of this tour / Tierra del Volcan Activity / Pumapucara S.A, your consent and acceptance of the clauses of this agreement and its applicability have been taken into account. Without this agreement, the cost of the tour would be much more expensive, or on the other hand Tierra del Volcan / Pumapucara S.A would not be able to provide these services.

You agree that by booking said activity/tour you are accepting this document electronically and it is the same as having the original signed document.
